Now in its 7th year of production, the Real Estate E&O Insurance Commercial Legal Update 2017 course continues to deliver the latest critical updates in legal and regulatory compliance, as well as best practice reminders for all commercial licensees in the province. For 2017, the Independent Advisory Group recommendations to the Council will guide discussions – additional new content that emerges from the recommendations will be introduced through 2017 as it becomes pubic. The reminder of the course will challenge commercial licensees with new and recurring topics, supported through court cases, consent orders, and tips for risk mitigation.

Commercial Legal Update 2017 strives to provide commercial licensees with crucial legal and regulatory updates, and best practice reminders. In the 2017 course, you will learn how these topics affect your daily practice and assist you in providing safeguards for your clients, as well as yourself.

By the end of this course, the learner will be able to:

  • describe recommendations pertaining to the licensee's professional conduct and regulatory change in the Independent Advisory Group's report on the conduct and practices in the real estate industry in BC;
  • describe some of the practice issues and complexities of assignments for commercial, development and residential markets;
  • list the real estate broker and sales representative main obligations under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act and Regulations;
  • describe the steps a licensee needs to take to meet his or her disclosure obligations;
  • list the due diligence "red flags" in a title search with attention to the types of charges that will pass upon a transfer of legal title and the obligations imposed by the Contract of Purchase and Sale for Commercial Real Estate;
  • explain the potential liability that may attach to a seller or a buyer when buying or selling a contaminated site, as well as how to limit liability for remediation costs;
  • describe the different residential and commercial spaces of a mixed-use development, and how these structures impact the rights and responsibilities of individual owners;
  • advise clients as to the benefits and risks of using drones as a real estate marketing tool, as well as the steps the licensee needs to take to operate a drone; and
  • explain the legal obligation imposed on parties based on the type of condition precedent at issue.
