Real Estate E&O Insurance Commercial Legal Update 2017 (Online Version)

The Real Estate E&O Insurance Commercial Legal Update 2017 is the real estate trading services profession's annual opportunity to stay current with recent developments in commercial real estate law and regulation. Divided into individual modules, this year's course emphasizes developments important to commercial licensees.

The Real Estate E&O Insurance Commercial Legal Update 2017 course will take you through some of the pressing issues illustrated through real estate law, and consent orders and discipline hearings. By end of this course, licensees will be able to:

  • describe recommendations pertaining to the licensee's professional conduct and regulatory change in the Independent Advisory Group's report on the conduct and practices in the real estate industry in BC;
  • describe some of the practice issues and complexities of assignments for commercial, development and residential markets;
  • list the real estate broker and sales representative main obligations under the Proceeds of Crime (Money Laundering) and Terrorist Financing Act and Regulations;
  • describe the steps a licensee needs to take to meet his or her disclosure obligations;
  • list the due diligence "red flags" in a title search with attention to the types of charges that will pass upon a transfer of legal title and the obligations imposed by the Contract of Purchase and Sale for Commercial Real Estate;
  • explain the potential liability that may attach to a seller or a buyer when buying or selling a contaminated site, as well as how to limit liability for remediation costs;
  • describe the different residential and commercial spaces of a mixed-use development, and how these structures impact the rights and responsibilities of individual owners;
  • advise clients as to the benefits and risks of using drones as a real estate marketing tool, as well as the steps the licensee needs to take to operate a drone; and
  • explain the legal obligation imposed on parties based on the type of condition precedent at issue.

This course may be completed at the student's own pace by reading online course materials, viewing online video presentations and successfully completing six short assignments. The only time limitation is a requirement that the assignments be completed within 12 months of registration in the course; note however, that the course must be completed prior to licence expiry date in order to satisfy PDP and/or REP requirements.
